Weldun, Inc. (“Weldun,” "we,” "us,” or "our") is committed to protecting your privacy. This privacy policy explains how we collect, use, disclose, and safeguard personal information (“Personal Data”) when you interact with our website at Weldun.co (the “Site”) and other online services that link to this policy, including any products available for purchase through the Site (collectively, the "Services").

This privacy policy applies to personal information that we collect and process in connection with your use of the Services. It does not apply to the privacy practices of third-party websites, services, or applications, even if they are accessible through the Services. However, when we share your personal information with service providers and third parties as described in Section 3, this privacy policy continues to govern our own handling and disclosure of that information.

Capitalized terms not otherwise defined in this privacy policy have the meanings assigned to them in our Terms of Service, available at https://weldun.co/pages/terms-and-conditions.

1. What Information We Collect About You 

1.1 Information You Provide to Weldun. When you interact with us through use of our Services, create an account, make a purchase, or contact our support team, we collect information you provide directly, including: your name, email address, physical address, and phone number (for account management, order fulfillment, and shipping labels); limited payment information as described below; information about your shopping preferences and product interests within the accessibility space, including but not limited to preferences related to adaptive features such as easy on/off functionality, sensory-considered design, healing and recovery needs, and similar accessibility-related attributes (collectively, “Accessibility Preference Data”). You acknowledge that Accessibility Preference Data may be considered sensitive personal information under applicable privacy laws. Our collection, use, and processing of Accessibility Preference Data is described in Section 1.2.5 below. We also collect any other information you provide when contacting us for customer support, submitting product reviews, or participating in promotions.

Your full payment card information is collected and processed directly by our designated third-party payment processor. Weldun does not store your full payment card details on its systems. We may have access to limited payment details, such as the type of payment card used and the last four digits of the card number, for order management and customer support purposes.

We store Accessibility Preference Data in your customer profile to personalize your shopping experience, improve our product recommendations, and inform product development. You may update your preferences through your account settings where available.

1.2 Information We Collect When You Use Our Services. 

1.2.1 Log Files. When you use our Services, we may automatically collect information about your computer hardware and software. This information can include your IP address, browser type, domain names, internet service provider (ISP), the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system, clickstream data, access times and referring website addresses. 

1.2.2 Usage Data. We collect usage data when you interact with the Services, including the pages you visit, the products you view or search for, the features you use, the actions you take, and the time, frequency, and duration of your activities. We may engage third-party analytics providers to help us collect and analyze this data. We use usage data to improve the Services, personalize your experience, and develop new features and product offerings.

1.2.3 Information from Cookies and Similar Technologies. We and our third-party partners collect information using cookies, pixel tags, and similar technologies. For detailed information on our use of cookies, the types of cookies we use, and your choices regarding cookies, please see Section 6 (Cookies and Tracking Technologies).

1.2.4 Device Information. When you use the Services, we may collect information about the device you use to access the Site, including device type, operating system, unique device identifiers, browser type, and diagnostic data. We use this information to optimize the Services for your device and to enhance security.

1.2.5 Accessibility Preference Data Processing. The Services collect data about your shopping preferences and needs within the accessibility space, which may include information about physical needs, recovery status, sensory considerations, and similar attributes. Because Accessibility Preference Data may be considered sensitive personal information under applicable privacy laws, we will obtain your affirmative consent before collecting, using, or processing Accessibility Preference Data where required by applicable law. Where consent is not required by applicable law, we process Accessibility Preference Data on the basis of our legitimate interest in personalizing your experience and improving our product offerings, as described in this Privacy Policy.

You have the right to withdraw your consent to the processing of Accessibility Preference Data at any time by updating your preferences through your account settings or by contacting us at hello@weldun.co. Withdrawal of consent will not affect the lawfulness of processing conducted prior to withdrawal. If you withdraw consent, we will cease processing your Accessibility Preference Data for personalization purposes, but you may continue to use the Services. You also retain the right to request deletion of your Accessibility Preference Data by contacting us at the address above.

2. How We Use Personal Data 

2.1 To Provide the Services. We use your account information to provide the Services to you, including processing and fulfilling your orders, managing your account, facilitating shipping and delivery through our brand partners and suppliers, processing returns through our designated returns management partner, and providing customer support. We use Accessibility Preference Data to personalize your shopping experience, including product recommendations and search results tailored to your needs.

2.2 To Improve and Develop Our Products and Services. We use data about how you interact with the Services to develop and improve our offerings. We may use Accessibility Preference Data, browsing behavior, and purchase history to identify trends, assess demand for product features, and inform product development. We may aggregate and/or de-identify data such that it no longer identifies or is reasonably linkable to any individual (“Aggregate Data”). Weldun owns all right, title, and interest in Aggregate Data and may use, share, publish, sell, license, or otherwise exploit Aggregate Data for any lawful purpose, including working with brand partners to develop products for the accessibility community, developing Weldun’s own products, conducting market research, and generating industry insights. Weldun will not attempt to re-identify Aggregate Data.

When we share statistical information externally, the data will be aggregated and de-identified so that it does not identify individual users. Weldun will contractually prohibit any recipient of Aggregate Data from attempting to re-identify any individual from such data. For the avoidance of doubt, Aggregate Data is not subject to any restrictions that apply to personal information under this Privacy Policy.

2.3 To Secure and Protect Our Users. We use your account information to investigate and help prevent security incidents. We may also use this information to meet legal requirements. We use your information to verify user accounts, process new account signups, detect and prevent fraud, and monitor for unauthorized activity.

We may use log files to provide general statistics regarding use of the Site, including how you use our Services, and to help improve the navigation experience. Your IP addresses are also collected and logged for security and debugging purposes, for example to track access patterns and investigate security events and incidents. For these purposes, we may link this automatically-collected data to other personal data provided by you.

2.4 To Communicate with Our Users. We use your account information to communicate with you, which could include providing you with order confirmations, shipping updates, and other information relating to your purchases, providing information that you request, and responding to comments, questions, and requests. By providing your email address or phone number to Weldun, you consent to receive transactional messages related to your orders and account. With your permission, we may also send you promotional emails or notifications about new products, sales, or other offerings. You may opt out of promotional messages at any time by following the unsubscribe instructions included in those messages or by updating your notification preferences in your account settings. We may still send you transactional messages, such as order confirmations and shipping updates. Mobile numbers and SMS consent are not shared, sold, or used for third-party marketing purposes.

2.5 To Support AI-Powered Features and Personalization. The Services may incorporate artificial intelligence (“AI”) and machine learning technologies to enhance your experience. These features may include: (a) customer service chatbots and virtual assistants to respond to and resolve your support inquiries; (b) smart search functionality to help you find products suited to your accessibility needs; (c) personalized product recommendations, landing pages, and content based on your browsing history, purchase history, and Accessibility Preference Data; and (d) operational tools used by Weldun to improve efficiency, product curation, and overall service quality. We may collect and use the content of your interactions with AI-powered features, including any personal information you provide, for the purposes of responding to your inquiries, improving the accuracy and effectiveness of our tools, and identifying trends and areas for service enhancement. Conversation data used for improvement purposes is aggregated or de-identified where practicable. We do not use support conversation data to personally identify users for marketing purposes. Weldun does not use AI-powered features to make automated decisions that produce legal effects or similarly significant effects concerning you, including decisions relating to eligibility, account access, or order processing, without meaningful human review. Not all AI-powered features described herein may be available at any given time. Weldun reserves the right to introduce, modify, suspend, or discontinue any AI-powered feature at any time without prior notice.

3. How We Share Personal Data 

3.1 Service Providers. We may share Personal Data with our third-party service providers to support our Services. These service providers may include providers for payment processing, order fulfillment and drop-ship logistics (our brand partners and suppliers), returns management, website hosting and analytics, customer support tools, and application development. We share your information with these service providers only as necessary to provide the Services to you. These service providers are contractually prohibited from using your Personal Data except for these purposes, and they are required to maintain the confidentiality of your information.

3.2 AI-Powered Features and Technology Partners. Certain AI-powered features of the Services, including customer service chatbots and smart search functionality, may be provided in collaboration with third-party technology partners. When you interact with these features, the content of your interactions, including any Personal Data you provide, may be collected, processed, and stored by the applicable third-party partner. We require our third-party technology partners to process Personal Data only as necessary to provide services on our behalf and in accordance with contractual data-processing obligations. We will identify the applicable third-party partners and make their privacy practices available to you upon request. We use this data to respond to your inquiries, improve our Services, and enhance search and personalization features. We do not use data from these interactions to personally identify users for marketing purposes.

3.3 Fulfillment and Logistics Partners. When you place an order through the Services, the applicable product is typically fulfilled by our third-party brand partners and suppliers through a drop-ship arrangement. To facilitate fulfillment and delivery of your order, we share certain Personal Data with the applicable brand partner or supplier, including your name, shipping address, phone number, and order details as necessary to complete the delivery. For returns, we share necessary information with our designated returns management partner. These partners are contractually required to use your Personal Data only to fulfill services on our behalf and to maintain the confidentiality of your information.

3.4 Compelled Disclosure. We reserve the right to use or disclose your Personal Data if required by law or if we reasonably believe that use or disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or comply with a law, court order, or legal process.

4. How We Transfer Personal Data Internationally. As of the date this privacy policy was last modified, Weldun only conducts business within the United States. However, certain third-party service providers we use to operate the Services may transfer or process Personal Data outside the United States. Where such transfers occur, we require our service providers to implement appropriate safeguards to protect your Personal Data in accordance with applicable law. In the event that we directly share Personal Data of individuals in the EEA, Switzerland, or UK with third parties in the future, we will comply with all applicable international data-protection laws to safeguard the transfer, including where required the use of Standard Contractual Clauses or other approved transfer mechanisms. We will update this privacy policy accordingly if our business operations expand internationally. Please contact us if you need more information about which legal mechanisms we rely on to transfer Personal Data internationally.

5. How We Store and Secure Personal Data 

5.1 Data Storage and Security. We use a variety of security technologies and procedures to help protect your Personal Data from unauthorized access, use or disclosure. We secure the Personal Data you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. All Personal Data is protected using commercially reasonable administrative, physical, technical, and organizational safeguards.

5.2 Retention of Personal Data. We retain Personal Data for as long as necessary to provide the Services, fulfill legal obligations, resolve disputes, or where we otherwise have an ongoing legitimate business need to do so. When determining the appropriate retention period, we consider the amount, nature, and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process the data and whether we can achieve those purposes through other means, and applicable legal, regulatory, tax, accounting, or other requirements. Specific retention periods include: data for active accounts (retained for the duration of the account relationship), data for inactive accounts (retained for up to [INSERT TIME PERIOD] following last activity to allow reactivation), post-transaction records (retained as required by applicable law), and support logs (retained for up to [INSERT TIME PERIOD] to address inquiries and disputes). When Personal Data is no longer required, we will securely delete or de-identify it.

5.3 Data Breach Notification. In the event of a data breach that compromises the security, confidentiality, or integrity of your Personal Data, Weldun will notify affected users without undue delay and in accordance with applicable laws. Weldun will also notify appropriate regulatory authorities as required by applicable law.

6. Cookies and Tracking Technologies. Technologies such as cookies, pixels, and similar tracking technologies are used by Weldun and our analytics, advertising, and service providers to operate and improve the Services, analyze usage patterns, personalize your experience, and support our marketing efforts. By using the Site, you consent to the use of cookies and similar technologies as described in this section and any cookie consent preferences you set through the Site’s cookie banner. You may have the option to either accept or refuse certain cookies through the cookie banner displayed when you first visit the Site. If you choose to refuse certain cookies, you may not be able to use some portions of the Services.

1. What Are Cookies? A cookie is a small file containing a string of characters that is sent to your computer or device when you visit a website. When you visit the site again, the cookie allows that site to recognize your browser. Cookies may store user preferences, shopping cart contents, and other information.

Cookies set by the website owner (Weldun) are called “first-party cookies.” Cookies set by parties other than the website owner are called “third-party cookies.” Third-party cookies enable third-party features or functionality to be provided on or through the website, such as analytics, personalized advertising, and interactive content. The parties that set these third-party cookies can recognize your computer both when it visits our Site and when it visits certain other websites.

We may use third-party analytics tools, including Google Analytics, to understand how users interact with our Site, analyze browsing behavior, optimize search functionality, and improve performance. These tools may collect anonymized usage data, device information, and interaction logs. Google may process this data on servers located outside the United States; for more information, please refer to Google’s privacy policy. We do not use this information to personally identify users.

2. Why Do We Use Cookies? We use first-party and third-party cookies for several reasons. Some cookies are required for technical reasons in order for our Site to operate (such as maintaining your shopping cart and session), and we refer to these as "essential" or "strictly necessary" cookies. Other cookies enable us to track and target the interests of our users to enhance the experience on our Services, personalize product recommendations and landing pages, and support our marketing efforts. This data is used to analyze trends, administer the Site, monitor how visitors navigate the Site, and gather demographic information about our user base as a whole.

4. How Can I Control Cookies? You have the right to decide whether to accept or reject cookies. Do Not Track and Global Privacy Control. Some web browsers may transmit "Do Not Track" (DNT) signals to websites. Our Services do not currently respond to DNT signals, as no uniform standard for interpreting or responding to such signals has been adopted. However, we recognize and honor Global Privacy Control (“GPC”) signals where required by applicable law. When we detect a GPC signal from your browser, we will treat it as a valid request to opt out of the sale or sharing of your personal information, as those terms are defined under applicable state privacy laws.

7. Your Privacy Rights and Choices. Depending on where you reside and subject to applicable law, you may have the following data protection rights:

1. Access, Correction or Deletion. You can request access, correction, updates or deletion of your Personal Data. 

2. Objection. You can object to our processing of your Personal Data, ask us to restrict processing of your Personal Data or request portability of your Personal Data. 

3. Withdraw Consent. If we have collected and processed your Personal Data with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your Personal Data conducted in reliance on lawful processing grounds other than consent. 

4. Complaint. You have the right to file a complaint with the applicable regulatory authority (such as your state attorney general or the Federal Trade Commission) about our collection and use of your Personal Data.

Please note that to protect Personal Data, we may verify your identity by a method appropriate to the type of request you are making. Depending on where you reside, you may be entitled to empower an “authorized agent” to submit requests on your behalf. We will require authorized agents to confirm their identity and authority, in accordance with applicable laws. 

We will respond to your request to change, correct, or delete your data within a reasonable timeframe (and in any event within the time period required by applicable law) and notify you of the action we have taken. In some instances, your rights may be limited, such as where fulfilling your request would impair the rights of others, our ability to provide a service you have requested, or our ability to comply with our legal obligations and enforce our legal rights. We will not discriminate against you for exercising any of your privacy rights.

8. State Privacy Rights. Certain U.S. state privacy laws, including the California Consumer Privacy Act (“CCPA”), the Virginia Consumer Data Protection Act, the Colorado Privacy Act, the Connecticut Data Privacy Act, the Texas Data Privacy and Security Act, and similar state laws, may grant you additional rights with respect to your personal information, such as the right to know what personal information we collect and how we use it, the right to request deletion, the right to correct inaccuracies, and the right to opt out of the sale or sharing of personal information. As of the date this privacy policy was last modified, Weldun does not meet the applicability thresholds established by the CCPA. However, to the extent that any state privacy law applies to our processing of your personal information, we will honor your rights under that law. To exercise any applicable state privacy rights, please contact us using the information in Section 9.4. We will not discriminate against you for exercising your privacy rights.

9. Other Important Privacy Information 

9.1 We Never Sell Personal Data. We will never sell your Personal Data to any third party. For the avoidance of doubt: (a) the use of cookies and similar tracking technologies as described in Section 6, including third-party advertising and targeting cookies, does not constitute a “sale” of Personal Data by Weldun, though certain state privacy laws may classify such activities as “sharing” of personal information; and (b) Aggregate Data (as defined above) does not constitute Personal Data and may be used, shared, or exploited by Weldun without restriction. You may opt out of third-party advertising cookies through the cookie banner on our Site or by enabling a Global Privacy Control signal in your browser.

9.2 Information About Children. The Services are not directed to children under the age of thirteen (13), and we do not knowingly collect Personal Data from children under 13. If we learn that we have collected Personal Data from a child under 13 without verifiable parental consent, we will take steps to delete such information promptly. The Services are intended for users who are at least eighteen (18) years of age, as set forth in our Terms of Service. If you believe that a child under 13 has provided us with Personal Data, please contact us at hello@weldun.co so that we may delete the information.

9.3 Changes to This Privacy Policy. Weldun may update this privacy policy from time to time by posting the revised policy on the Site with an updated “Last Modified” date. If we make material changes to how we collect, use, or share your Personal Data, we will notify you by posting a prominent notice on the Site or by sending you an email (if we have your email address on file) at least thirty (30) days before the changes take effect, unless a shorter notice period is required or permitted by applicable law. Your continued use of the Services after the effective date of any update constitutes your acceptance of the revised privacy policy. We encourage you to review this privacy policy periodically to stay informed about our privacy practices.
